The Government of Troll's Bane

Tattered official parchments have been tidied or replaced and many old notes have been removed from the Town walls.

Interested parties are urged to refrain from using the Town notice boards for temporary and personal notices or to air minor disagreements. Rather individuals are encouraged to meet with officials in the Town or send them word.

Government Model

Following election of the new Town Council on 16. Olos 35, the Government model has been amended to accommodate the suspension of the post of Governor.

Government Model

The Commonwealth of Trolls Bane includes the town proper and its accompanying boroughs; these include Midlands, Eastmark, Southfields, Riverside, Northbridge, Oakwood Shire, and Athen (West Strand). The boroughs are not permitted to remove themselves from the Town's jurisdiction. All boroughs are subject to the laws of the land as well as taxes.

The Commonwealth of Trolls Bane is to be governed by a Council of Citizens, one equal in worth to another.

The previous position of Governor is suspended and all duties pass to the Head of the Council; this can be reversed and the position of Governor reinstated in the future by a 3:0 vote by the Council.

All elected officials are required to be active and being absent and nonresponsive for more than one Dwarven week without any prior warning may lead to being ousted and replaced by another democratically elected official.

The nominated positions of Judge and Captain of the Guard are similarly required to be active and being absent and nonresponsive for more than one Dwarven week without any prior warning may lead to replacement.


Citizens

All Citizens have the right and power to vote in every town wide election as well as lobby their elected officials at regularly scheduled town meetings. At least one Government official must be available to meet with Citizens at least once every two Dwarven weeks.

The Citizens have the power to recall any elected official at any time during the term. To recall an elected official due to displeasure with their job quality then an official grievance must be made publicly including any specific objections. Once this document has been written and known publicly, the council needs to vote at least 2:1 in support of the recall petition. If this too is passed then a public vote is taken where support for the recall must also reach a 2:1 ratio at the end of the voting. During this vote citizens will also name their preferred successor (single name only) and if the recall passes the highest preferred successor will take their place. A complaint may also be filed for inactivity. An inactive representative will be on notice for one Dwarven week - if they do not respond then a replacement will be chosen by citizens.

All Citizens of Troll's Bane have the right to own land or structures within the Commonwealth.


Council

The Trolls Bane council will be made up of three members, one of which is elected as the Head of Council.

All Council members are elected to a term of six Dwarven months each.

The vote of each Councillor will carry equal weight.

The power and purpose of the Council is to collect taxes, write and pass laws, confirm nominated individuals for the posts of Judge and Captain of the Town Guard, sign treaties with other settlements, and allocate Town money for various projects.

In absence of a Governor, the Head of Council will formally nominate individuals for the posts of Judge and Captain of the Town Guard, enforce Town laws, head the Town during wars or states of emergencies, write treaties with other settlements, finalise land contracts with Citizens and residents, propose tax increase or decreases, and request Town money for various projects.

All Council members have a responsibility to defend the Town and to protect Citizens and visitors alike; they are expected to contribute through membership of an Ancillary Guard Corp.

Any Government official that is not a Guard may invoke a short and temporary ban on any individual after personally witnessing some crime or disturbance. Allowing for such bans will help cut short tense conflicts and will help keep the Town safe before the criminal complaint is officially filed. If no charges come from the complaint the ban must end immediately. The ban cannot last longer than two Dwarven days.


Judge

The power and purpose of the Judge of Troll's Bane is to understand the Contract between the Government of Troll's Bane and her Citizens to ensure that all laws, treaties and projects approved by the Council are legally binding. The Judge also presides in all criminal trials and is to keep an eye on any possible corruption of other Government officials.

The Judge may be recalled if a town meeting of at least a third of the town people show up and demand the Council vote on a recall, then it is up to the Council to unanimously vote to recall the Judge; doing so will result in the banishment of the Judge.

The Judge has a responsibility to defend the Town and to protect Citizens and visitors alike; they are expected to contribute through membership of an Ancillary Guard Corp.


Captain of the Town Guard

The power and purpose of the Captain of the Town Guard is to protect the people from all enemies, enforce the laws of Troll's Bane, maintain the Town Guard, and request funds from the Council.

The conduct of lesser ranking guards will reflect upon the Captain himself. Any misconduct or ethical complaints involving the Captain or lesser ranking guards may be written and sent to either the Judge and/or Head of Council. If the individual making the complaint feels the Judge and/or Head of Council are biased and unable to review the situation fairly they may request an independent Citizen be added to the group that looks over the complaint; this request must be accepted by the Government.


Elections

Terms for all Council members are six Dwarven months, and the date of the next set of elections must be posted soon after the last election has finished.

The citizen list will remain open between elections but should be closed immediately after all nominees have been announced for a new election to avoid any possibility of fraud. Citizens thought to be inactive will have a mark placed next to their name one Dwarven week prior to the Citizen list closing and during that time they may appeal their inactive designation.

Once the nominees are known the election must begin no longer than five Dwarven days later. The election must last at least two Dwarven days and the time the election ends must be firmly set by whoever is presiding over the election. Voting will be done via a secret non-changeable ballot.

Troll's Bane Law

In all instances where possible, criminal complaints will be accepted from the districts as well as within the Town walls.

Where guilt is immediately admitted by an individual for a minor offence, the Captain of the Guard or another Officer may issue a fine to ensure expedient execution of proceedings.

Where the suspect denies guilt for a minor offence the case must be referred to the Judge.

The Judge will decide all cases of criminal complaints for all medium and serious offences, as well as disputed minor offences, following thorough review of the case including interviewing of all complainants, witnesses, and suspects.

For the most severe offences and controversial cases the Judge may employ a jury of 3-5 of the suspects peers to make recommendations, although (s)he will preside and retain the overall judgement.


Offences

I. Minor Offences

A. Theft
Anyone who takes property against the will and/or knowledge of the owner is committing theft. If convicted the criminal must give back the items (or something of equal value) to the original owner plus an added fine or service to be paid to the Town treasury and/or victim.

B. Break in and Trespass
Breaking into a house or other establishment against the will or knowledge of the owner, or refusing to leave when asked to do so, is an act of trespass.

C. Disturbance
Anyone who disturbs the peace of the Town with hostile, destructive, or disturbing acts that interfere with the usual business of Citizens and Visitors alike should cease immediately upon request.

Acts of disturbance may include but are not limited to:
- Use of explicit language in a lewd or aggressive manner.
- Persistent pressuring of individuals to buy products or services.
- Discarding of waste and other items over pathways.
- Leaving mules unattended for excessive periods of time.
- Prolonged and excessively loud arguments.
- Formation of excessive magical constructs in a manner that may interfere with others.
- Lighting of fires in pathways and in other busy public spaces.

If the disturbance continues despite warning from a proper authority the individual will be subject to a criminal charge and may be removed from Town to protect the interests of others. Any further punishment will be subject to review by the Judge on request.

D. Assault
Assault occurs when one person attacks, but does not kill, another with their own body, designed weapons, other objects, or magic. Voluntary violence between two individuals(duelling) is permitted outside the Town walls or in designated sparring areas.

E. Defamation of Character
Anyone who purposely designs and spreads false claims, either written or spoken, to harm another individual’s reputation, either out of malice or to benefit themselves, is committing defamation.

Prosecution of an individual will require clear evidence of harm to a person’s reputation whereby the respect, regard, or confidence in which they are held is damaged and disparaging opinions or hostilities are induced. This must be accompanied by proof of overt malice or likely personal gain. All cases of defamation must be scrutinised by the Judge or another nominated official.

F. Conspiracy to Commit a Crime
Planning, attempting, or inciting others to break laws is a criminal offence in itself even if the intended action never occurs.

Conspirators acting directly against the Government of Troll’s Bane will be judged under the more serious offence of treason.

G. Prostitution and Lewd Behaviour
Isolated offences will normally be dealt with as a disturbance but where an individual persistently sells their body in an explicit manner or engages in any other form of overtly lewd behaviour within the Town walls they can expect to be charged to appear before the Judge. Punishments may include a warning or fine in initial cases and a ban or loss of Citizenship in repeated cases.

H. Threat and Duress
Threatening a Citizen or Visitor with violence, or trying to force them into doing something against his/her will is crime against the law.

I. Claiming False Status to Authorities
Impersonation of a Government Official or Guard, or claiming false status to such authorities, to acquire some form of benefit, are both considered to be criminal acts.


II Medium Offences

A. Endangering the Public
Although minor incidents may be dealt with as a disturbance if no individual is hurt or unduly alarmed, hostile, destructive, or disturbing acts that pose a threat to Citizens and Visitors within the Town will generally be considered a more serious offence.

Such acts may include but are not limited to:
- Creation of explosions.
- Lighting, or leaving unattended, dangerously situated or excessively large fires.
- Formation of magical constructs that have the ability to harm others.
- Repeated killing Mummies of Madness to allow them to multiply.
- Drawing of dangerous creatures into the Town.
- Fishing without the means to contain and remove any undead that may be disturbed.
- Digging for treasure without the means to contain and remove any guardians aroused.

B. Obstruction of Justice
Anyone perverting or distorting the course of justice, interfering with law enforcement or preventing the law enforcement from fulfilling their tasks commits a crime under the law.

C. Resisting Arrest
Resisting arrest through physical or verbal means is a crime, as is trying to prevent the arrest of someone else and/or sheltering them.

D. Disobedience
Anyone who refuses to follow official orders of the Town Guard or the Government, especially those who refuse imprisonments, bans or other official punishments, is committing a crime. If an individual feels the official order is unfair they should follow it regardless and raise their concerns with an appropriate official to allow proper review of events.

E. Robbery
In cases of thievery where the victim is threatened to be harmed by violence the crime is considered to be of greater severity and should be punished accordingly. When violence is actually used and not just threatened the crime of assault or attempted murder will be considered along with robbery.

F. Kidnapping
Capturing or holding someone against his or her will is a criminal act. Included in this are incidents of coercion where an individual is purposely drawn to a specific location for nefarious purposes.

G. Attempted Murder
Attempted murder is a crime where it can be seen that the perpetrator attempted to murder the individual, or that the victim was sufficiently and severely wounded to justify that.

H. Criminal Damage
Intentional destruction or damage to the property of another, including that of the Town, will be regarded as criminal damage. Where unintentional damage occurs to property the owner should be sought to offer compensation.


III. Serious Offences

A. Spying
Spying for the benefit of another organization is a criminal act that may severely endanger the people and stability of Troll’s Bane. The magnitude of punishment is dependent on the sensitivity of information passed, the organization for which the spying has been conducted for, and the duration of the betrayal. Spying must always be considered as Category III crime until proven otherwise.

B. Murder
When a person is irreversibly killed by another and there is sufficient evidence to prove the act was not in self-defense, it is considered murder ((OOC: Only Perma-deaths can be murder)). Anyone accused of murder who does not immediately turn themselves in will be regarded as an outlaw and can be killed on sight.

C. Arson
Intentional destruction or damage to the property of another, including that of the Town, through the use of fire will be regarded as the more serious crime of arson as life may be endangered. Where unintentional damage to property is caused by fire the owner should be sought to offer compensation.

D. Treason
Any individual, who alone or in a group, commits an act against the interests of Troll’s Bane is guilty of treason.

Such acts may include but are not limited to:
- Inciting rebellion.
- Belonging to, associating with, assisting, or supporting a group which plans to overthrow the Government.
- Assassination or attempted assassination of a Town official or any other individual working for the Government.
- Spying.



Punishments

If the suspect is found guilty of an offence there are a number of punishments that may be recommended either individually or in combination:


Fine:
Payment of money by the criminal may be ordered to compensate victims and/or reimburse costs to the Town. Typically the fine will be split proportionally between victims and the Town. If the crime was committed against one person then the victim would receive half the value of the fine and the Town itself would get half; in the event of there being two victims the fine would be split three ways, and so forth.

Time in the Pillory:
Petty criminals committing minor infractions of the laws may be sentenced to time in the pillory where Citizens and visitors are encouraged to demonstrate their disapproval through the throwing of mouldy fruit and bad fish. A criminal can be ordered to spend a maximum of two Dwarven hours in the pillory.

Temporary Banishment:
A convicted criminal may be banned temporarily from the Town limits for a maximum of one Dwarven week by the Judge.

Temporary bans may also be employed prior to conviction to keep the peace and allow the Guard to fulfil their duty. A ban of one Dwarven day can be applied by the Guard to quash minor disturbances and to allow proper investigation of a crime; where necessary this may be extended to one Dwarven week by the Captain of the Guard or another Officer.

Breaking of any temporary ban may lead to further charges being levelled against the perpetrator.

Resource Collection:
Often used in conjunction with a temporary ban, the criminal can be directed to gather resources for the Town; completion of the task they are assigned should draw their punishment to a conclusion so they can be readmitted to the Town as a reformed character.

Resources ordered may include lumber, ore, coal, stone, leather, fur, ash, meats, fruit, crops, herbs, and wool. Manufactured products may also be ordered, particularly if the criminal has a known trade. Time allowed and quantities ordered are at the discretion of the Judge; the type of resource should where possible be discussed with a Council member to ensure the most urgent Town needs are met. At the conclusion of the punishment the resources must be handed to a town official and transferred to the treasury within one Dwarven week.

Labour Contract:
Labour contracts are most suitable for persistent offenders or criminals who have committed more serious crimes. Again this form of punishment is likely to be used in conjunction with a ban. A labour contract will be sold to the highest bidder for a period of not less than two Dwarven weeks, nor more than two Dwarven months. The profits of this contract will go direct to the treasury.


It is hoped that most crimes will be reasonably dealt with in this way although in extreme circumstances where the lives of Citizen's continue to be put at risk, or a Criminal refuses to pay their fine or accept any other form of punishment, the Judge may recommend the following more severe actions:


Permanent banishment:
The criminal is permanently excluded from the Town limits and may be attacked if they fail to adhere to this order. This punishment is only to be used in futile cases concerning the most severe of crimes, namely murder, as it offers no opportunity for rehabilitation of the criminal or provision of compensation to their victims.

Removal of Citizenship:
If the criminal is currently a Citizen of Troll's Bane they may lose status as a Citizen and any benefits that may come from that.

Kill order:
In serious cases the Judge may issue a kill order for the most heartless offenders who commit murder and other serious crimes. Such criminals may be attacked at will by any individual with the means to do so without fear of prosecution as they are acting against an unrepentant felon of the worst kind.


Further punishments may be suggested by the Judge on an individual basis where deemed appropriate but will require Council approval (majority vote).


Recommended Tariffs

In order to expedite the legal process and to help ensure fair application of penalties the Council has issued recommended minimum and maximum tariffs for minor and medium offences.

This system will enable greater punishment of repeat offenders and also consideration of any mitigating circumstances.

It must be remembered though, these tariffs are only recommendations, and where agreed under special circumstances more appropriate punishment may be issued.

Due to the serious and often complex nature of more serious crimes, the Council will not recommend specific tariffs but as always is available if discussion is warranted.

It has come to my attention that the Town has not been surveyed recently and the older maps may not be entirely accurate these days. I would like to invite Citizens or other interested parties to produce two maps - one of the Town itself with the buildings marked 1-12 as listed and one of the Commonwealth with the districts marked I-VIII as listed.

All applications for the job should be sent to myself. Preference will be given to applications by Citizen's in the event of there being multiple candidates. A small reward will be provided by myself to the successful applicant on completion of the maps.

Owners of this structure are responsible for a 20 silver per dwarven month tax.

Refusal to pay this tax or prolonged inactivity of all owners, lasting one dwarven month or longer, puts the structure in danger of being repossessed. The owners may hand official ownership to other individuals if they desire.

The structure and surrounding land are part of Troll's Bane and the town laws are in effect. Any attempt to remove the structure from Troll's Bane jurisdiction voids this contract.

Land Ownership: Responsibilities, Rights, and Procedure

Both Citizens and Residents can own property with the bounds of the town and its districts. If multiple parties desire the same area of land then the Citizen(s) will be preferred over Resident(s).

Whenever there is a change in Government all current land owners have the right to retain their land and be safe from confiscation. The Head of Council may renew the old contracts; renewals do not require a Council vote. An owner is eligible for renewal if they are the long-standing owner or have been viewed as the owner or manager at some time. No purchase fee should be paid for renewals.

The Head of Council may renew and make new building claims for individual buildings under the Town's ownership. This does not require a Council vote.

Buildings important as town resources cannot be sold to private owners. These include the library, the jail, and the shop near the East Gate.

A land owner has the right to pass ownership on to a successor that is a Citizen or Resident and they must be in good standing with Troll's Bane. One loses good standing if they have an unresolved crime in the categories of robbery, assault, murder, or kidnap or have been convicted of such in their recent past. Crimes in the distant past may be overlooked if good behaviour followed.

Land or buildings may be confiscated under the following conditions:
1) The owner attempted to remove the property from Troll's Bane's jurisdiction.
2) The owner committed a heinous crime or declared war on Troll's Bane.
3) The owner has gone inactive for more than a Dwarven month.
4) The owner voluntarily gives up their right to ownership.

Districts may be sold for an initial purchase fee. Taxation rates may also be negotiated. Unlike renewals, new land claims (new owner for a confiscated district) must be voted on by the Council and require a 2:1 majority or better.

The Government cannot edit a contract without first consulting the owner(s).

Land owners have the right to manage as they wish as long as their actions do not break Town laws and do not break the terms of their contracts.

It has come to my attention that the Town has not been surveyed recently and the older maps may not be entirely accurate these days. I would like to invite Citizens or other interested parties to produce two maps - one of the Town itself with the buildings marked 1-12 and one of the Commonwealth with the districts marked I-VIII as listed on the official Government parchments.

All applications for the job should be sent to myself. Preference will be given to applications by Citizen's in the event of there being multiple candidates. A small reward will be provided by myself to the successful applicant on completion of the maps.

Town Reforms

Following recent discontent regarding judgement and punishment of suspected and proven criminals the Council has entered into debate over various problems and intends to issue a number of reforms to alleviate the difficulties faced in keeping law and order within the town.

The first of these reforms has now been voted on and ratified with a majority vote.

The Judge oversees sentencing and makes a recommendation to council. The ruling is concrete until the council meets and decides if the ruling will stand or dissolve. The high judge is responsible for making judicial rulings in a court setting but does not have the authority to ban or pass any laws.

Each guard can make a one day ban on his own, it would be up to the Guard Captain or Officer to extend the ban or leave it at the one day. Guards must only enforce the current laws, not make up new ones or bend any rules

The job of the council is mainly passing laws, up-keeping Trolls Bane and keeping political relations between themselves and other cities. The council should only be able to unban with a vote.

Unless someone from the Kingdom of Silverbrand actively is present and watches the tavern, Trolls Bane will be forced to annex the building into the town proper. Without monitoring of someone other then Borgate who simply serves the ale, the tavern in Trolls Bane becomes a haven for those who want to break the laws of the town. This will be ratified officially in a dwarfen week.

I may not have been in Trolls Bane as long as some but i have never seen the inn monitored by anyone, yourself included.
I think the emphasis is on the term "actively" rather than attending the inn once a week/month/year.

A year may be nothing for your people but it is a fair amount of time for others.
When those that frequent that inn also cause issues outside of it then it puts the guards and government in a position where even if those causing issues are banned from the town they are still able to frequent the inn.

I am unaware of any contract but it seems that a major concern for me is that the government of the town in which the inn is placed has no authority over it and the Kingdom that owns the inn does nothing, in my personal view, to oversee it.
Therefore making it the perfect haven for wrongdoers.

I feel the Kingdom of Silverbrand should recognise and respect the towns authority outside of the inn and work with the government in keeping those fugitives of the town out of the inn.

Does the contract you have with the town of Trolls Bane have any clauses within it that determines this level of responsibilty?

I. Subject of the treaty
1. Subject of this treaty is the Fluffy Sheep Tavern defined in the east by the walls of the tavern building, in the west by the river, in the north and the south by the walls of the tavern building and the hedges in the following only called “Tavern”.

II. Ownership
1. The Tavern is property of the Kingdom of Silverbrand.
2. The Tavern is to be treated as a part of the Kingdom of Silverbrand.
3. The only law coming in effect on the Tavern’s ground is the law of the Kingdom of Silverbrands.

Under the Rights and Regulations, it says "The Kingdom of Silverbrand may not do anything on the ground of the Tavern that endangers the Town of Troll’s Bane" Doesn't harboring fugitives and criminals do just that??? Either way, the criminals must tread on Bane soil to get to the Tavern. I would suggest increased patrols of the area by Bane, but it seems silly that Bane should have to post Guards outside the doors of a Tavern owned by Silverbrand, just because they are unwilling to monitor their property on their own. Though I think the Guard should take advantage of the clause that they may "capture any criminal that is taking refuge in the Subject of the treaty, as long as he is no citizen of Silverbrand or subject to the King." Still, Silverbrand should monitor their property... you would not want fugitives and criminals in the hallowed halls of your city, would you?

I agree with what you said Samantha but you also failed to mention another point.
Although it may not seem too likely, what if a serious incident was taking place between a Silverbrand citizen and another, whether they be of Trolls Bane or merely passing through, with the Silverbrand citizen being the instigator.

One clause states that the guards may deal with the situation yet another clause states that the guilty party could not be arrested.

Also, If there was a fight between Silverbrand citizens and, for arguements sake, Halflings from Greenbriar would the town of Trolls Bane be "expected" to deal with the situation?

Very good point. I doubt the Guard could punish the offender once they exit the tavern, because technically the crime occurred on Silverbrand soil, but they could hold Silverbrand accountable for the behavior of it's citizens. Have the incident brought before the King and ask him to handle the punishment. That way the crime has been reported, and no toes stepped on in the process. I should think the King would desire his subjects to refrain from starting wars over barroom brawls. I believe that's all Troll's Bane is asking for, really. They want to be sure their citizens are safe, and it's rather difficult when the tavern is becoming a haven for criminals.

There is no "issue". My King has payed the tavern out of his very own pocket. He built it with his very own hands. He and the Kingdom own it for decades and still every new goverment tries to take it from him. With what right? How can you even think about taking something in which you did not even put the slightest piece of work?
Concerning benefits, I belive Troll's Bane benefits enough from the tavern. Not only you are supplied with best dwarven ale, but also the tavern attracts travelers - potential customers to your merchants.

The tavern will never ever be part of Troll's Bane. No discussion, just accept it!

The idea is NOT to take property from your King. Merely to create a safe environment for the residents and visitors of the town that the inn is based.
If your King is willing to employ a guard to be based there on a regular basis then that in my view is also a viable option.

In this instance i believe the cons weigh up equally to the pros. The inn may attract travellers and potential customers but it also encourages lawbreakers and even those facing an active ban from the town to congregate in the inn. Thus causing potential business to drop as many people may refuse to drink at the inn through fear of being attacked by any outlaws in there.

I believe that if the circumstances were reversed and it was your Kings subjects that felt their town had a haven for criminals that was owned but not policed at all by Trolls Bane I'm sure your King would try and negotiate with Trolls Bane to come up with a solution that could ensure the safety and wellbeing of his subjects.
You state that it is not an issue but it is not your wives, friends and children whose safety and wellbeing is compromised.

Surely that would be counter productive as if there was a war over it the Dwarves of Silverbrand wouldn't be able to enter Trolls Bane so the inn would be available to nobody.

I am not trying to start a quarrel at all and as I previously stated. My opinions and questions are my own and do not reflect those of the Trolls Bane government nor its citizens but i fail to see how there can be "No discussion" over a topic that in my eyes needs to be addressed.

Until the matter has reached a conclusion i would also like to know who i contact with regards to a kidnap and viscious assault that took place on the land of the Kingdom of Silverbrand

However the story you tell does not explain the bruises on my body that are coincidently the same size as your generals fist, it doesn't explain the friction burns i received when your general dragged me across the carpet to throw me down the stairs and it also doesn't explain how i ended up face first in the pigs fields.

On a separate topic to my incident.
I have noticed that there was an increased presence in the inn as of late from the Kingdom of Silverbrand which is all i was enquiring about.
