Town Guard of Troll's Bane

Town Guard Of Troll's Bane
Town Guard:
Competence of the Troll's Bane Town Guard:

1.) The Town Guard of Troll´s Bane was given the duty to care for the security of the town by the Governor of Troll's Bane.

2.) The Troll's Bane Town Guard will act within the borders of Troll's Bane and within the laws of Troll's Bane. The guard will be observed by the ruling of the Head of Council and/or the High Judge.
If you feel mistreated by a guard, don't panic! Don't use vigilante justice! Talk to the captain of the guard instead, or directly to the Governor or the High Judge.

3.) The Town Guard of Troll's Bane was founded to enforce the laws of Troll's Bane and to protect the citizens of Troll's Bane inside the borders of the town.

4.) In case of emergency or an investigation the citizens are told to obey the guards words. Hindering them in their duty or resisting their decisions is prohibited. Mind that the guards will be chosen considerate and know what they are doing. If you wish to participate in protecting the town and its citizens, you can apply for the post of a guard.
A direct attack on any of the guards results in a direct one week ban.

5.) In general, the guards are told to wait for a trial before deciding upon the fate of a person. However, if the life of a citizen or the life of a guard is in direct danger, a criminal tries to escape or major rules of Troll's Bane are violated, the guard got certain options:
a.) A temporary one day ban may be imposed by a guard, to secure the town until the High Judge has spoken, this ban can be pushed to one week by the Captain of the Guard or acting Captain if one is not present.
b.) The guards have the right to attack and maim a criminal who tries to resist against a ban and poses a direct danger to the safety of town.




All guards have an expectation for behavior that they should keep in mind at all times. Complaints will be investigated, and if there is any wrong doing, there will be warnings.

1 Case - Suspended from the guard for a week
2 Cases - Suspended from the guard for a week, 15 silver fine
3 Cases - Expelled from the guard, further criminal and or citizenship punishments to be discussed


Positions:

Captain-
The job of the captain is to oversee the guard as a whole and make sure all of the
guards are doing their jobs properly. The captain is responsible for making sure
each of the guards gets paid. All guards answer to him/her.

Lieutenant-
This position is what was formerly known as Lieutenant. There will be one officer per
5 guards. When the guard captain is not available, the officers will have the same
authority as the captain. Officers will be given money from the captain for each of
the guards in their division.

Sergent-
This position is for outstanding guards who have served the guard for a long enough
time, and well enough that they have become potential candidates for promotion to
Officer. These guards have no more power than standard guards.

Guard-
This position will make up the main body of the guard. They are to use the recruits
to support them in any situation. They will be able to deliver fines and indefinite
time of banishment.


Recruit-
This position is for new recruits. Recruit will be there to support the other guards.
They will only have authority to make banishments, and for no more than a week's time.
Recruits answer to all other guards.

Recruitment and promotion:

Captain:
The captain is to be proposed by the governor, and needs a unanimous vote from the council to be voted in.

Lieutenant:
The potential officers are to be brought to the council by the guard captain, and a simple 2/3 majority vote will grant them the position

Sergent:
The potential lieutenants are to be brought to the council by either the guard captain, or their respective officer, and a simple 2/3 majority vote will grant them the position

Guard:
Recruits can be made guards either with the support of one councilman, the governor, or through deliberation of the guard captain and each of his officers

Recruits:
Recruits can be admitted to the guard by either a councilman, the governor, or the guard captain. Also officers are able to nominate citizens to the position of recruit.


Benefits of the guard:

Payment:
Each guard will be paid once a dwarven month, and be supplied with whatever equipment deemed neccesary
Guard pay will be given to the Captain, and then he/she will split the money between his officers to give to each of the guards under them

Captain: 30 silver

Lieutenant: 26 silver

Sergent: 22 silver

Guard: 20 silver

Recruit: 10 silver


The Judge will decide all cases of criminal complaints after hearing everything that needs to be heard from those involved. Criminal complaints will be accepted from the districts as well, not just inside the town walls. If a guilty sentence is decided there may be a number of punishments:

Fine: A payment of money from the criminal. The fine will be split proportionally. This means that if the crime was committed against one person then the town itself would get half of the fine and the victim would get the other half. If there are two victims then it will be split 1/3 to each, and so forth.

Banishment: Someone may be banned from the town for one day by a guard. The Captain of the Guard (or acting Captain) may push this to one week if the High Judge cannot hold trial at that time.

Removal of Citizenship: If a criminal is currently a citizen and they refuse to pay their fine or accept their ban then they may lose status as a citizen and any benefits that may come from that.

Kill order: In serious cases the judge may issue a kill order for the most heartless offenders who commit murder and other serious crimes. A kill order means that any action may be taken against this individual by others (including theft, murder) and no one will be prosecuted for those actions as they are being done against an unrepentant criminal of the worst kind.

I. Minor Crimes

A. Thievery
Anyone who takes property against the will and/or knowledge of the owner is committing thievery. If convicted the criminal must give back the items (or something of equal value) to the original owner plus an added fine to be paid to the town treasury or also to the original owner.

B. Break in/Trespassing (Private building)
Whoever breaks into a house of an individual against the will or knowledge of the owner, or refuses to leave when asked to is engaging in trespass. At which time said owner may act as they see fit.

C. Disturbance
Anyone who interrupts the peace of the town with hostile, destructive, or disturbing acts should cease immediately upon request. If they continue despite warning from a proper authority then they are subject to a criminal charge.

D. Assault
Assault occurs when one person attacks another with their own body, with metal weapons, or with objects, but does not actually kill the person (murder). Voluntary violence between two individuals (dueling) is permitted outside the town walls.

E. Defamation
Everyone who purposely designs and spreads false claims to harm someone else or to benefit themselves commits a crime in terms of the law. The crime is especially grave if it involves unfounded accusations against the guard.

F. Conspiracy to commit a Crime
Should a person be caught in the act of planning, attempting or inciting others to break the laws and regulations alone or in a group, he or she is subject to the exact same punishment as he would get for doing the crime.

II Medium Offences

A. Claiming false status to Authorities
Claiming to be an official or guard for some kind of benefit when one actually is not is a crime under the law and will be dealt with accordingly.

B. Obstruction of Justice
Anyone perverting or distorting the course of justice, interfering with law-enforcement or preventing the law enforcement from fulfilling their tasks commits a crime under the law.

C. Resisting Arrest
Resisting arrest through physical or verbal means is a crime under the law. Trying to prevent the arrest of someone, or sheltering him/her else by the same means is an equal crime under the law.

D. Disobedience
Everyone who refuses to follow official orders of the Town Guard or the Government, especially refuses imprisonments, bans or other official punishments commits crime in terms of the Law.

E. Robbery
In cases of thievery where the victim is threatened to be harmed by violence the crime has to be raised in seriousness to Robbery. When violence is actually used and not just threatened the crime has to considered as assault or attempted murder along with robbery.

F. Threat and duress
Threatening a citizen or a resident with violence, or trying to force them into doing something against his will is crime against the law.

G. Kidnapping
Capturing or holding someone against his or her will is a crime against the laws. Included in this are acts of coercion where one purposely draws an individual to a specific location for nefarious purposes.

H. Attempted Murder
Attempted murder is a crime where it can be seen that the perpetrator attempted to murder the individual, or that the victim was sufficiently and severely wounded to justify that.

III. Serious Crimes

A. Spying
Spying for the benefit of other town or organization is a crime under the law. The magnitude of punishment depends on the graveness of the leaks, to which organization/town the spying has been conducted for and the duration of the spying. Always treat the case as category III.III crime until proven otherwise.

B. Murder
When a person is irreversibly killed by someone else, and it cannot be determined that this was in self-defence, it is seen as Murder in front of the law. ((OOC: Only Perma-deaths can be murder))
Anyone accused of Murder who doesn’t turn him/herself in immediately becomes an outlaw.

C. Arson and Damaging of property
Anyone who through fire or any other means, intentionally damages the property of the town, an individual, or a group commits a crime under the law. One who causes unintentional fire damage should seek to pay the owner for repairs.

D. Treason
An individual, who alone or in a group, commits any or all of the following acts may be found guilty of treason: Inciting a rebellion. Belonging to, associating with, assisting or supporting a group which plans to overthrow the government of Trollsbane or assassinating a person belonging to or working for the government (or planning to do those individually). Anyone convicted of spying may also be punished for treason, and vice versa.

After hearing enough I sentence Alexander Knight with banishment from Troll's Bane for 1 Dwarven week for uttering threats of violence and disturbing the peace. If Mr. Knight is unable to leave the hospital due to his injuries his sentence will start when he has recovered and is able to leave. If further time is require to heal Mr. Knight shall remain inside the hospital until he is ready to leave.

Alexander Knight, please sign here on your way out of Troll's Bane. This will mark the beginning of your sentence.

Guy Mitchell is currently banned from Trollsbane until he is tried by the magistrate. His crimes include:

-Threatening and drawing a blade on an innocent by-stander.
-Failure to follow the direct orders of a town official. x 2
-Threatening a town official.

I offered to let him go with a fine of 25 silvers due to this being his first offense, but he declined, so I have banished him from town until he can be tried by the magistrate. If he is in town, guards may do whatever is necessary to escort him from the premises.

I request that Darian Estiel contacts me as soon as possible to discuss this issue.

So I am expected to stand by idly when I come upon a situation where a man is threatening the lives of innocent people within our walls? This ban is temporary, and it stands until he is able to be tried properly by Darian. It is simply for the protection of our citizens and others within the walls of our town. I fail to see this reason provided by one Wulfgar, for why he has granted himself the right, which is not stated in his own governments constitution. True, one cannot allow their people to come to harm, and true again, one must null such threat. Although, I feel if one Wulfgar feels the need to protect his citizens better than his own guard, perhaps he should step down and join the 'guard'. Which, one may point out, there seems to be little of to speak thereof.

Perhaps, if he spent more time setting about running this government more smoothly and employing said guards, than he did over-stepping himself, he wouldn't have to read such words. But to refresh the point, you've granted yourself rights not permitted. You are in the wrong, fix the guard, or join it.

If there is a problem, then file a complaint. I have a hard time seeing such a complaint going anywhere when my actions were so clearly made with the intend of protecting this town. However, due to the problem you both seem to have with me working for the protection of this town, I will see to it that something is done about this situation.

On the other hand, maybe instead of trying to tell me how to do my job, you should join the guard yourself, raising its numbers, and therefore makiing it so that others don't have to overstep their bounds.

Just a suggestion.

If you see this as an attack, you're sadly mistaken, it's merely observations. Although you do a good job of avoiding the actual problem, you yourself created by trying catapult your problem onto others. You may note, people aren't angry with you, but rather your attitude to your Constitution. For example, you come off as a perverted farmer with sheep, you're doing everything which is wrong, yet you still don't sheer the beast.

But to end this one quickly, I'm not telling you how to do your job, your Constitution does a just enough job for that. I'm simply stating an observation that you're abusing it by not setting up the other Branches of government to coincide with it.

PS: Once you start doing your job, some might actually think it worth while to support this government by joining the guard.

Hello Troll's Bane,
I believe I need to clear a number of things up. Altrix is indeed in the wrong. Not because his actions were unjust but because his name is not Kaidan or someone who supported Kaidan. There is a statute in the constitution that apparently many of you are not aware of. Originally I had run out of ink so it may be hard to read. If you look real close maybe you can make out the etchings of my quill on the parchment. The statute states:

-Officials may not help in the matters of law enforcement. Citizens may, in particular if they genuinely believe themselves to be morally superior to all others, and especially if their name is Kaidan. Under such circumstances they may create bans and assault those they have disagreements with whenever and wherever they wish.
Citizens

All Citizens have the right and power to vote in every town wide election as well as lobby their elected officials at regularly scheduled town meetings. Town meetings held by at least one government official must be held at least once every two Dwarven weeks.

The Citizens have the power to recall any elected official at any time during the term. To recall an elected official due to displeasure with their job quality then an official grievance must be made publicly including the specific grievances. Once this document has been written and known publicly, the council needs to vote at least 2-1 in support of the recall petition. If this too is passed then a public vote is taken where support for the recall must also reach a 2:1 ratio at the end of the voting. During this vote citizens will also name their preferred successor (1 name only) and if the recall passes the highest preferred successor will take their place. A complaint may also be filed for inactivity. An inactive representative will be on notice for 1 dwarven week -- if they do not respond then a replacement will be chosen by citizens.

Kaidan is the only one who may criticize others for acting while not being named Kaidan. As they say, Altrix has clearly not done his job at all. Meanwhile Kaidan has been hard at work creating bans out of thin air by saying things like "you have three seconds to leave town or I'm attacking you" or assaulting another citizen before ever consulting the judge, or the governor and council if it involved a crime in another town requiring diplomatic cooperation. Altrix asking for pocket change as a fine is clearly out of bounds. And who better to point this out than the man who actually has the authority under the constitution to judge whoever he wishes and then act on it?

And lest you dare call him a partisan for only taking the time to criticize those opposed to him personally or politically. He is immune from this as well. In fact only he may be the judge of who is a partisan. If he says you bribed someone when you did not .. too bad. If you say he bribed someone when he did, you are in the wrong by definition. If he tries to hire a female to emotionally harm another citizen, or complains about a land owner because he doesn't like them or prefers his friend to be the owner, that is not being a partisan. If you do anything he doesn't like then you have to be one. We should be thanking Kaidan for his diligent service to the town. Seredoc raised pointless issues such as "who should have a say in land ownership contracts". Kaidan has taken the torch and has brought his pious ways to the all important category of "complaining about things that never actually happened," like a fine that was never collected or a governor's non-intrusion into judicial affairs.

We will be working hard to have Altrix's name legally changed to "Kaidan" so that he may act as he pleases without judicial oversight against those he believes are morally lower (which are certainly all other people on the island). If anything changes I will keep you all updated.

This would almost be a good argument...except that recently your judge, a member of the government that you represent has supported Kaidans actions be inflicting the punishment of a bane on aAexander Knight. Regardless of whether or not he was in the right or the wrong with his actions, the man was attacked by Kaidan and forced to the cross, one would consider that an act of attempted murder. Yet Kaidan was not punished in the statute of the law for his actions. Regardless of his motives, unless he was under direct physical threat of violence is it abundantly clear that he still broke the law. How can you chastise the people of bane when your own government is shown to support vigilante actions? Your government as a whole is then guilty of the same accusations you toss at everyone else? It gives the appearance that the law bends in the direction favored by those in charge.

Both parties should have faced punishment not just one.

Guy Mitchell temporary ban has been lifted.

As for the case involving Alexander Knight. My judgment was based not only on his confrontation with Kaidan but with other citizens of Trollsbane who have come forward. All my judgements are subject to review upon receiving new information.

New information is not required, the attempted murder of Alexander knight was never addressed. The facts of that subject have already been made known to you. Kadian assaulted the man and sent him to the cross, the man never drew a blade upon him or struck him with other then words, so the written reports say. What more information do you need to address those actions under the law? Popular opinion should not be the measure by which the law is bent.

On this night I found Willumhill Graveltoes in state of injury. I tended him and rescued his bag. After questioning him, I went to the mine and killed three ogres, Citizens and Guests please do not use the copper hills alone. There are things there which can hurt you.

A dwarf, possibly female a very quick sketch is drawn 1340****** just made a very big fire outside the tavern of Troll's Bane using atleast 40 logs, then left it unattended and I can not put it all out myself!

We would like fires for ash to be set outside of the town walls. Fires can spread and damage the buildings around them so if a citizen is concerned we will show up to put the fires out. If Bendura was banned then I am lifting the ban.

I declare Leva Beliu and Shandra clear of any charges. Name calling and stubbornness is not a crime. Any acts of aggression were out of self defense towards a guard who clearly escalated a situation which could have easily been defused.

Furthermore, I'd like to request that Alexander Knight be removed from his position as guard. I don't believe he is fit for this position at this time. If Captian Skull'Fed feels that this is an overreaction I will put it to the vote of the council.

Due to the recent decision by the judge Stefan Elvaris will now be the officer of the guard and will handle many day to day responsibilities.

Perhaps a demotion instead of a complete removal from the guard?

A treaty with Silverbrand has been drafted but not finalized.
Treaty of the Fluffy Sheep Tavern
Between the
Town of Troll’s Bane
And the
Kingdom of Silverbrand

I. Subject of the treaty
1. Subject of this treaty is the Fluffy Sheep Tavern defined in the east by the walls of the tavern building, in the west by the river, in the north and the south by the walls of the tavern building and the hedges in the following only called “Tavern”.

II. Ownership
1. The Tavern is property of the Kingdom of Silverbrand.
2. The Tavern is to be treated as a part of the Kingdom of Silverbrand.
3. The only law coming in effect on the Tavern’s ground is the law of the Kingdom of Silverbrands.

III. Rights and Regulations
1. The Kingdom of Silverbrand has the right to enforce the law with all necessary means.
2. The Kingdom of Silverbrand has the right to ban people from the ground of the Tavern.
3. The Kingdom of Silverbrand may not do anything on the ground of the Tavern that endangers the Town of Troll’s Bane
4. The Town of Troll’s Bane may prevent immediate danger by using it’s armed forces.
5. The Town of Troll’s Bane may capture any criminal that is taking refuge in the Subject of the treaty, as long as he is no citizen of Silverbrand or subject to the King.

IV. Validity of this treaty
1. This treaty is binding for all following goverments.
2. Violation or termination of this treaty may be interpreted as an act of war.
3. This treaty comes into effect with the signature of both partys,

For using a weapon unprovoked on an unarmed citizen and abuse of authority, I don't believe removal from the guard to be too harsh. There is no reason for a guard to demand to speak privately with a citizen and to do so by force. Guards should not be making demands of anyone unless laws are broken or safety is at stake. To be honest I thought I was quiet lenient.

Perhaps in the future if Alexander Knight show's a change in attitude and better judgment he can be reassessed and readmitted into the guard, but as for the time being I don't believe the guard to be a good position for him.

Walking up to the board Alexander quickly writes a few laws down. Perhaps they mean something.
